Proposed Special Resolution:

  1.       The Owners Corporation hereby resolves by Special Resolution, in accordance with section 18 of the Owners Corporations Act 2006, to commence legal proceedings against the builder and/or any other responsible parties or entities in relation to building defects at the Property in any Court or Tribunal of competent jurisdiction. (“Legal Proceedings”)
  2.       The Owners Corporation hereby resolves to delegate to the Committee of the Owners Corporation full authority to give all appropriate instructions to the Lawyers engaged by the Owners Corporation to commence and conduct the Legal Proceedings and full authority to negotiate and settle the Legal Proceedings.

Special Resolutions 1 and 2 must be voted on as one indivisible whole.

Important.

  • Forms submitted after 5.00pm on Monday 30th of March 2026 will be ruled invalid.
  • Votes will be tabulated according to the unit and proxies nominated by the voter in this form (regardless of any other units they own or proxies they hold).
  • Only one vote per financial lot is permitted.
  • Owners are advised that they have the right to appoint a proxy for this ballot. Submit a proxy here.
