Victoria & Vine Special Resolution Ballot – Short Stay Levy.
In line with the recently passed Short Stay Levy Act 2004, Owners Corporations now have the ability to amend their Registered Rules to prohibit the use of any lot for short stay accommodation, except where the owner or lessee occupies the lot as their principal place of residence.
In accordance with the Owners Corporation Act 2006 Section 138, a Special Resolution is required to amend the Registered/Rules of the Owners Corporation.
The Committee of Management have requested a ballot vote be taken to establish the position of Apartment Owners, in respect to this matter.

- Forms submitted after 5.00pm on Tuesday 15 April 2025 will be ruled invalid.
- Votes will be tabulated according to the unit and proxies nominated by the voter in this form (regardless of any other units they own or proxies they hold).
- Owners are advised that they have the right to appoint a proxy for this ballot.

Victoria & Vine – Proposed Special Resolution
1. To be resolved by special resolution pursuant to Part 8, Sections 138, 138A and 138B of the Owners Corporations Act 2006, that Owners Corporation Plan Number propose the following Special Resolution that hereby adds/creates and registers the following Rule:
The use of any Lot as/for short-stay accommodation is prohibited, except where an owner of a Lot, or a lessee or sub-lessee of the owner of a Lot occupies the Lot as their principal place of residence and that person provides the Lot as/for short-stay accommodation.
“short-stay accommodation” means accommodation provided under a short-stay accommodation arrangement.
“short-stay accommodation arrangement” has the same meaning as defined in the Owners Corporations Act 2006, or if there is no definition at any time, it means a lease or licence (or other agreement) for a continuous period of less than 28 days to occupy a lot or part of a Lot.
2. A consolidated copy of the Rules certified by the Secretary of the Owners Corporation be lodged with the Registrar.
3. The Owners Corporation may execute all necessary documents to implement the Rules and give notification of making, amendment or revocation of the rules in the prescribed form to the Land Titles Office by bearing the signature, name, title and address of two owners of separate Lots.
