Resolutions to be voted on:

Resolution 1

Owners Corporation Plan 532365Q (OC) resolve as a special  resolution within the meaning of section 96 and 97 of the Owners Corporation Act 2006 (OCA) to issue legal proceedings against the builder and any party in connection with damage to property caused by the fire on 4 February 2019 and/or for the rectification or alternatively the costs of rectification of non-compliant or defective building work on common property and to make any interlocutory application the OC consider appropriate and to do all things and sign all such documents by affixing the owners corporation’s seal under section 20 and 21 of the OCA as may be required to give effect to this special resolution, settlement with the builder and any concurrent wrongdoer, and the prosecution and determination of the proceedings.

Resolution 2

Owners Corporation Plan 532365Q (OC) resolve as a special  resolution within the meaning of section 96 and 97 of the Owners Corporation Act 2006 (OCA) to provide a service pursuant to section 12(1) of the OCA to all of lots of issuing legal proceedings against the builder and any party in connection with damage to property caused by the fire on 4 February 2019 and /or for the rectification or alternatively the costs of rectification of non-compliant or defective building work on lot owners private property including but not limited to consequential damage (including any uninsured consequential losses) and to make any interlocutory application the OC considers appropriate and that the committee is delegated authority in respect to that service, including power to settle or compromise the proceedings the OC shall cause the carrying out of the rectification works on lot owners’ private property and that the costs of this   service under S12(2) of the OCA shall be borne by all owners on a lot liability basis and the OC shall do all things and sign all such documents by affixing the owners corporation’s seal under sections 20 and 21 of the OCA as may be required to give to this special resolution, settlement or compromise or determination of the proceedings and the carrying out of rectification works.  The costs of the legal proceedings are to be borne by the insurer.
