1. The Owners Corporation hereby resolves by Special Resolution, in accordance with section 18 of the Owners Corporations Act 2006 to bring legal proceedings against the builder and any other responsible parties or entities in relation to building defects and/or recovery of money spent to rectify building problems at the property, in any appropriate Court or Tribunal of competent jurisdiction. (“Legal Proceedings”)
  2. The Owners Corporation hereby resolves to delegate to the Committee of the Owners Corporation:
    • full authority to give all appropriate instructions to the Lawyers engaged by the Owners Corporation to commence and conduct the Legal Proceedings; and
    • full authority to attend mediation or compulsory conference, for negotiations with any party and to settle the Legal Proceedings at their discretion.
